Booth Rental Waiver 

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT 

In consideration for the booth rent opportunity at E and E Hair Salon, 10228 Lake Arbor Way Bowie, MD 20720, I hereby acknowledge and agree to the following: 

  1. I understand the hazards of the novel coronavirus (“COVID-19”) and am familiar with the Centers for Disease Control and Prevention (“CDC”) guidelines regarding COVID-19. 

  2. I agree to abide by the attached Guidelines, and require my clients to abide by all Guidelines in order to continue to booth rent at E and E Hair Salon. 

  3. I acknowledge and understand that that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the CDC guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates. 

  4. I acknowledge that the stylists and all booth renters, and employees of E and E Hair Salon agree to abide by these same standards and affirm the same, to include but not limited to requiring my clientele to abide by safety protocols of the salon and established by the State of Maryland. 

  5. I also affirm that as a booth renter I have improved and expanded my sanitation protocols to more thoroughly prevent the spread of COVID-19 and other communicable conditions to include sanitizing combs, brushes, etc. after each use, and to document such change. 

  6. I also affirm that in order to provide services at E and E Hair Salon, I will be required to wear a mask, gloves, and smock at all times, and to change them after each use, and to document the change. 

  7. I also affirm that in order to provide services at E and E Hair Salon, all stylists and booth renters will be required to wash their hands prior to the start of their service. 

  8. I also affirm that in order to provide services at E and E Hair Salon, all stylists and booth renters will ensure the bathrooms are cleaned after each use by clients and stylists. 

  9. I also affirm that in order to continue to booth rent and provide services at E and E Hair Salon, I will not overbook clients, make appointments and practice appropriate social distancing with other stylists and clients. 

  10. Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to continue to booth rent and perform salon services at E and E Hair Salon. 

  11. I acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises, inviting clients and participating in E and E Salon activities at 10228 Lake Arbor Way Bowie and hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Evie Johnson, or E and E Hair Salon, their owners, officers, directors, agents, employees and assigns from any liability related to COVID-19 which might occur as a result my being on the premises and participating in salon activities. 

  12. I shall indemnify, defend and hold harmless and release E and E Hair Salon, and Evie Johnson from and against any and all claims, demands, suits, judgments, losses or expenses of any nature whatsoever (including, without limitation, attorneys’ fees, costs and disbursements, whether of in-house or outside counsel and whether or not an action is brought, on appeal or otherwise), arising from or out of, or relating to, directly or indirectly, the infection of COVID-19 or any other illness or injury. 

  13. It is my express intent that this Waiver and Hold Harmless Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE E and E hair Salon and Evie Johnson. This Agreement and the provisions contained herein shall be construed, interpreted and  controlled according to the laws of the State of Maryland.

I HEREBY KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL OF ANY DISPUTE ARISING IN CONNECTION WITH THIS AGREEMENT. I ACKNOWLEDGE THAT THIS WAIVER WAS EXPRESSLY NEGOTIATED. 

IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Wavier of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same. 

ADDITIONAL GUIDELINES 

The Salon and my stylists are following these enhanced procedures to prevent the spread of COVID-19: 

  • Additional time included between appointments to sanitize service areas and to minimize guest contact. 

  • Increased distance between clients to adhere to safe social distancing guidelines. 

  • No visitors during your service. 

  • Each guest is required to wash or sanitize hands upon arrival. 

  • Your service provider will thoroughly wash and sanitize hands as often as possible. 

  • Everyone in the space must be masked. 

  • Guests receiving services must wear a mask or face shield that covers the nose and mouth completely. 

  • All surfaces and restrooms will be wiped thoroughly with hospital grade disinfectant before and after each client.

  • Routine temperature checks of staff and clients.
